So did anyone here predict that Space Jam 2 out of all films booted a MCU from the top spot of the box office weekend? I can't help but find that a bit amusing. Did...did...Bugs Bunny get ahold of the Infinity Gauntlet? A family film that appeals to all ages, parents with kids, first dates, etc, beat out a rather violent film about abusing girls? It does make a bit of sense in that light. I do wonder if Scarlett's outspokenness on women's pay and sexploitation hurt some of the viewership. We saw Brie impact Captain Marvel. It's not that they don't have a right to speak, but maybe they shouldn't until their movies come out. A certain number is sure to be turned off by that, and when your film drags like that, it kind of smacks the underpaid theory down. I remain shocked by the number of lingering butt shots given all that Scarlett had to say on that topic. Captain Marvel made over $1 billion at the box office. Not really much impact. Perhaps not much on the direct profit board, but the word of mouth on that film somehow regularly lands it in the one of the worst discussions. I mean, the worst MCU film is still a pretty good position to be in, but I think it's a better film than it's perception. I'm really just desperately looking for any weird factors hitting against the BW success.

Space Jam may have won a battle but Black Widow is winning the war for now As it currently stands, total BO for both: BW: $232,309,167 SJ: $53,153,362 Marvel released some marketing earlier today with an authoritative narrator stating that Black Widow was the number one movie in America for the second week in a row. When I fact-checked them, I was surprised to find they were telling the truth (more or less). Space Jam: A New Legacy technically only outperformed Black Widow this past Friday. Black Widow grossed more on Saturday, Sunday, and this past Monday. Snake Eyes is the favorite to take next weekend.

Seen this twice now. Really like the family stuff. I wish there was more of it. Would’ve been nice to see their relationships grow over a trilogy. The plot seemed worse the second time though. The rebooted Widow program, the magic gas cure, Taskmaster and Russian Harvey Weinstein are the weakest elements of the movie.
I might see it a third time next week. Nothing else to see right now and being back in the theater is too awesome to resist.

wait,,, so they weren’t even allowed to do this technically? Would it not fall under “force majeure” where Disney will simply say they were forced by unforeseen and uncontrollable events to adjust the release in this way? I’m not hating on Scarlett, but it’s not like she’s the only one losing in this whole situation.

After reading some of the actual complaint, I, Lord Death Man, Esq., doesn't think Nat has a case.
With new variants on the rise and mask mandates returning in some regions, the statement above seems disingenuous AF. The film was already postponed for years. How much longer should they have made eager audiences wait? The MCU is a narrative whole made up of interdependent pieces; one hold up at the train station means dozens of other trains can't get moving. Let's be real, somebody bought a third house and was banking on those Widow dollars to pay for it. I can dig it. Why didn't she sue months ago when they announced it was coming to premier access? Obviously, the shortfall in her bonus means she's coming out of pocket to pay the Johansson management team - which still wants their end regardless of what the box office did or did not do.Some people don't want to go to the movies right now. How is forcing them to go to increase profits morally or ethically correct? Scarlett, we love you, but please keep up with your pilates and we'll hook you up for the sequel prequel. The skincare line and your charity work can wait.

All kidding aside, this is a hassle for her more than it affects her personal bottom line. She took home a well-deserved $20 M paycheck upfront. The $50 M in points she wants her slice of is likely to keep payroll for some production company moving - and to bankroll a transition from female-action-star to GOOP style mogul. A contract is indeed a contract. The complaint "alleges" that Disney "promised" an "exclusive" theatrical release. But did they? That just seems unlikely. Putting aside any emotions you might feel for Scarlett, why would Disney promise anyone a release of their movie limited to a single vertical c. 2021? If Disney opted to debut the film on streaming, there was likely no explicit legal barrier preventing them from doing so. If there was an explicit exclusivity clause, no risk officer worth their salt would have green-lit premier access. We will know if this is real if less high-profile entities also vested in BW backend points follows Scarlett's lead on the litigation train. Right now, the burden of proof is on team Johanssen to prove Disney intentionally released the film on streaming to cut her out of the profit-sharing loop. She's got very little in the way of proof and even less in leverage. Her franchise dead-ended at birth, and she was not aggressive about inking post-Widow deals with Disney. There's probably some, "well yeah we can give her an equivalent take of the D+ buys that makes it all fair" solution to this and it won't really matter. I mean it's just an odd time. My bigger question is what is WB doing with all of the films they put on HBO Max for free???

This is an interesting case. I'd expect, as LDM suggested, that a risk officer checked contracts to ensure they could release the film as they did, but there was also a reasonable expectation of performance at the time of her contract. That said, many, many people were put out during this time, in the film industry particularly, so I'm not sure that reasonable expectation remains relevant. I'd expect some out of court settlement, though honestly, they could shut her up with a Disney branded film of her choosing. If we see her in a near future Disney film, we'll know how they chose.

I didn't realize how much I was missing those until now :-) As someone who used to write corporate and group sales contracts, sometimes for relatively large $100K events, I can say that we always included what's known as Force Majeure language. And basically this just meant that in the case of some unforeseen circumstance (a hurricane, somebody drives their car into a power grid, etc), we retain the right to not adhere to the letter of the contract. The intent being that we would do everything in our power to provide the best result possible to the extent we could. I don't know actor contracts, but I'd be shocked with vastly more money being on the table, if there weren't similar "reasonable" out clauses. So the question is, what's reasonable here? Obviously the market has been drastically changed and Disney reasonably has the right to adjust their business model to be as effective as possible. It is also reasonable to acknowledge that Scarlett isn't the only one having to sacrifice here. The entire company and everybody involved is. Is it then also reasonable to consider contracts and make renegotiations where possible to fulfill the intent? Yeah I think that's reasonable. Again, I don't know all the details, but the suggestion that prorating her deal in some way vs the purchases on D+ is probably the correct thing to do. I don't know if it's legally required, but as Taylor mentioned it saves face, and sounds reasonably fair enough. Regardless she can't expect the same return she might have gotten, but virtually everybody has had to take cuts this past year. And in the end we're actually discussing a millionaires vs billionaires context here that I don't think deserves a whole lot more attention. Nobody is going hungry in this contest.

Your response is superbly reasoned and firmly rooted in the realities of American contract law. I admire Scarlet Johanssen just as much as the next fan. I think she is highly talented, intelligent, and dedicated to her craft. She stands side by side with the aging male stars of the all-boys action club. She could have easily had a Taken or Equalizer style franchise with little effort many times over. The fans are being irrational in their belief that Disney is somehow putting her out on the breadline. A part of her legal team's strategy will be to make Disney look like they are a bunch of money-hungry corporate douchebags who live to stiff the little guy (which they mostly are). There will also, no doubt, be narratives surrounding sexism in her treatment by Disney. Get ready for a slew of headlines in the trades surrounding gender-based compensation disparities. I think the optics are equally bad for her, though, in that she now has the distinction of starring in Marvel's lowest-grossing movie. Her actions could be perceived as sour grapes. And, there's also her perceived willingness to put people at risk in theaters for the sake of her points. The complaint sounds borderline callous in the respect. It's very Goodfellas. "Got hit by lightning, huh? Fuck you, pay me!" If this were ANY OTHER Franchise, I'd give it to her that they could have waited longer to release the movie, but given the interconnected nature of the MCU, that doesn't seem realistic. And also, she seemed happy enough to do the marketing in which she - herself - promoted the date repeatedly. I do think that she over-estimated Marvel's ability as a machine to overcome the pandemic, rampant piracy, and lukewarm interest in a long-dead character - we all did. The truth of the matter is that streaming will put an end to cushy back-end deals and fiscally unsound profit-sharing agreements. The pie is getting smaller, and everybody involved will need to learn to live with less - until the next great frontier of fan/consumer exploitation reveals itself. And yes, I need to get back to my roots. Hee hee hee...
